Under Article 6 of Law 2664/1998 as amended by Article 2(3) of Law 3127/2003, initial entries are those recorded as such at the cadastral office on transfer from the cadastral tables. In the event of erroneous entries, an action (declaratory or revindicatory) is brought by any person with a legal interest, within an exclusive time limit expiring on 31 December of the year in which eight (8) years from the start of the time limit are completed. Under Article 102(2) of Law 4623/2019 (Official Gazette A 134/9.8.2019), «2. For areas declared under cadastral survey before the entry into force of Law 3481/2006, the exclusive time limit of point (a) of Article 6(2) of Law 2664/1998, if neither it nor its extensions had expired by 30.11.2018, expires on 31.12.2020», while pursuant to Article 134 of Law 4759/2020, «The time limit provided for in Article 102(2) of Law 4623/2019 (A’ 134) is extended by one year, and Article 102(2) of Law 4623/2019 is amended to read as follows: ‘2. For areas declared under cadastral survey before the entry into force of Law 3481/2006 (A’ 162), the exclusive time limit of point (a) of Article 6(2) of Law 2664/1998, if neither it nor its extensions had expired by 30.11.2018, expires on 31.12.2021.’».
In the case of an inaccurate initial entry bearing the indication «unknown owner», the person prejudiced by the inaccurate entry may seek correction of the initial entry by an application to the cadastral judge or, until such judge is designated, to the Single-Member Court of First Instance of the location of the property, sitting under the voluntary jurisdiction procedure. By way of exception, where correction of an initial entry on a land parcel marked «unknown owner» is sought, and the beneficiary invokes extraordinary adverse possession as their title of acquisition, the action provided in Article 6(2) is brought against the Greek State.
It is therefore clear that failure to submit a declaration of ownership during the cadastral survey may place property owners in the unfavourable position of having to bring legal proceedings in order to have their properties registered in their name and their ownership recognised. For this reason our firm advises property owners to carry out a timely check on the completeness and accuracy of the initial entries concerning their properties.
