Compensation Award Against a Public Legal Entity

Our firm handled with great success the case for recovery of EUR 2,033,360 with interest from 2011 and EUR 240,000 with interest from 2017 against a municipality in the southern suburbs of Athens, as compensation for the use of properties belonging to our client company, which the municipality had unlawfully collected from a local businessman.

More specifically, the municipality was leasing out three coastal plots of approximately 6,500 sq.m., owned by our client, by trespassing on them and treating them as if they were public-use spaces.

The eviction of the municipality in enforcement of a court judgment took place in April 2012, and that case too was handled successfully by our firm.

Thus, on the compensation actions, Supreme Court (Areios Pagos) judgment No. 1777/2023 was issued, upholding Athens Court of Appeals judgment No. 4099/2020 (in respect of the sum of EUR 2,033,360), while Supreme Court judgment No. 655/2023 upheld Athens Court of First Instance judgment No. 3170/2017 (in respect of the sum of EUR 240,000).

Supreme Court judgment No. 655/2023, being of jurisprudential interest, has already been published in a well-known legal information database.
