Documents Required for the Notarial Acceptance of an Inheritance

In the event of death, where succession arises either by intestacy or by will, it is necessary to draw up a notarial deed of acceptance of inheritance, which constitutes the heir’s legal title. To complete this procedure the following documents are required:

  1. Death certificate
  2. Certificate of next-of-kin
  3. Copy of the minutes of publication of the will (if there is a will)
  4. Certificate of non-publication of another will, or of non-publication of a will at all, from the competent Court of First Instance and Justice of the Peace Court for deaths occurring before 1 March 2013; for deaths after 1 March 2013, the relevant certificate is required only from the Justice of the Peace Court.
  5. Certified copy of the inheritance tax return from the competent Tax Office
  6. ENFIA (real-estate tax) certificate
  7. Cadastral folio and diagram (where the acceptance concerns an immovable), or a certificate of surveyed property for areas where no Cadastral Office is yet operational
  8. A recent topographical diagram containing the declarations of Law 651/77 and Law 1337/83, where what is being inherited is a plot of land or a parcel for which no titles of acquisition (deeds) exist
  9. The deceased’s title of acquisition
  10. Where the acceptance concerns a property included in the town plan after 1983, a certificate is required from the municipality in which the property is located confirming that a declaration of ownership has been submitted; if the act of application has been ratified, a certificate that any monetary contributions have been paid in full is also required.
